Section 46/47

Sections 46 of the Foyle Fisheries Act (Northern Ireland) 1952 and 47 of the Foyle Fisheries Act 1952 permits the removal of river bed material from the freshwater portion of any river in the Loughs Agency’s area. Loughs Agency, Foyle, Carlingford and Irish Lights Commission (FCILC) may, by permit in writing, and subject to any conditions specified in the permit, authorise any named person to do such things as may be specified in the permit.

A Section 46/47 permit authorises the holder to carry out activities which may otherwise be illegal.

Section 69

Sections 69 of the Foyle Fisheries Act (Northern Ireland) 1952 and 70 of the Foyle Fisheries Act 1952 provide exemptions for acts done for artificial propagation, scientific purposes or improvement of fisheries. Loughs Agency, Foyle, Carlingford and Irish Lights Commission (FCILC) may, by permit in writing, and subject to any conditions specified in the permit, authorise any named person to do, at any season of the year, such things as may be specified in the permit for the purpose of artificial propagation of salmon or freshwater fish, scientific research or the improvement of fisheries.

A Section 69/70 permit authorises the holder to carry out activities which would normally be illegal. Example of activities permitted under the authority of these permits include catching, by electro fishing, and being in possession of salmon or trout for supportive breeding programmes, or catching fresh water fish by an approved method for transfer between inland fisheries.
